You will also generally need to be outside Australia when the Student visa is granted.<\/p>\n<p>This means that the visa you currently hold is now very important.<\/p>\n<h3><strong>Which visas are affected?<\/strong><\/h3>\n<p>The new rules cover a range of temporary visas.<\/p>\n<p>These include:<\/p>\n<ul>\n<li>Visitor visa (subclass 600)<\/li>\n<li>Working Holiday visa (subclass 417)<\/li>\n<li>Work and Holiday visa (subclass 462)<\/li>\n<li>Temporary Graduate visa (subclass 485)<\/li>\n<li>Training visa (subclass 407)<\/li>\n<li>Temporary Activity visa (subclass 408)<\/li>\n<li>Skills in Demand visa (subclass 482)<\/li>\n<li>Temporary Work (Short Stay Specialist) visa (subclass 400)<\/li>\n<\/ul>\n<p>and a number of other temporary visa categories.<\/p>\n<p>So, this is no longer just an issue for people who come to Australia as visitors. It can also affect people who are already working, training or living in Australia on another temporary visa.<\/p>\n<h3><strong>Here&#8217;s a simple example<\/strong><\/h3>\n<p>Imagine you are in Australia on a Working Holiday visa (subclass 417).<\/p>\n<p>You enjoy living in Australia and decide you would like to study a diploma or degree.<\/p>\n<p>Under the new rules, you generally cannot simply stay in Australia and apply for your Student visa.<\/p>\n<p>Instead, you may need to:<\/p>\n<ul>\n<li>Leave Australia<\/li>\n<li>Apply for the Student visa offshore<\/li>\n<li>Wait for the visa to be granted<\/li>\n<li>Return to Australia.<\/li>\n<\/ul>\n<p>This is why it is important to understand the rules before your current visa gets close to expiring.<\/p>\n<h3><strong>What about people on a Temporary Graduate visa?<\/strong><\/h3>\n<p>This is particularly important for people on a Temporary Graduate visa (subclass 485).<\/p>\n<p>Perhaps you have finished your studies, are working in Australia and then decide that you want to study another course.<\/p>\n<p>Under the new rules, you may not be able to simply apply for another Student visa while remaining in Australia.<\/p>\n<p>You may need to leave Australia and make your Student visa application from overseas.<\/p>\n<p>Your individual circumstances and any available exemptions need to be checked before making plans.<\/p>\n<h3><strong>What does this mean for &#8220;visa hopping&#8221;?<\/strong><\/h3>\n<p>The Government has introduced these changes as part of measures to strengthen the Student visa program and reduce people using successive temporary visas to extend their stay in Australia.<\/p>\n<p>In simple terms, the pathway:<\/p>\n<ul>\n<li>Temporary visa<\/li>\n<li>Stay in Australia<\/li>\n<li>Student visa,<\/li>\n<\/ul>\n<p>will no longer be available to almost everyone.<\/p>\n<p>For some people, the pathway will now be:<\/p>\n<ul>\n<li>Temporary visa<\/li>\n<li>Leave Australia<\/li>\n<li>Apply for Student visa offshore.<\/li>\n<\/ul>\n<p>This doesn&#8217;t mean Australia is closing its doors to international students.
